1. Scope

These Terms of Service (“Terms”) apply to the public legal portal at https://legal.hopelab.eu (“HopeLab Legal”) and to the HopeLab services that are listed as active on HopeLab Legal (each a “Service”, together the “Services”).

HopeLab Legal publishes Terms, Privacy Policy, and service-specific information so that users and third-party platforms (for example Discord Developer Portal) can link to stable public URLs. Individual Services may have additional rules described on their service pages. If a service-specific page conflicts with these Terms on a Service-specific operational point (for example access roles or data categories for that Service), the service page controls for that point.

2. Acceptance of these Terms

By accessing or using HopeLab Legal or any Service covered by these Terms, you agree to these Terms. If you do not agree, do not use the Services.

If you use a Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Access and accounts

HopeLab Legal itself does not require an account. Some Services may require authentication (for example Discord OAuth2). Where a Service uses Discord or another identity provider, you must comply with that provider’s terms as well as these Terms.

  • You are responsible for activity that occurs under your authenticated session or account for a Service.
  • You must provide accurate information where a Service asks for it, and keep credentials and linked accounts under your control.
  • We may suspend or restrict access where reasonably necessary to protect the Service, other users, or to address suspected abuse or legal risk.

4. User content and licences

“User Content” means material you submit, upload, create, import, or store in a Service (for example character sheets, notes, text, images, or other files), excluding materials we provide as part of the Service interface.

You retain ownership of your original User Content, subject to any rights of third parties in material you include. You are responsible for ensuring you have the rights needed to submit User Content.

You grant [Operator Name] a limited, worldwide, non-exclusive licence to host, store, reproduce, process, display, and transmit User Content solely as needed to operate, maintain, secure, and improve the relevant Service, to provide features you use (including sharing with roles you authorize, such as game masters where applicable), and to comply with law. This licence ends when User Content is removed from our systems, except for reasonable residual copies in backups that are deleted according to the applicable retention practice, and except where we must retain material to meet legal obligations.

5. Prohibited conduct

You must not misuse the Services. Without limitation, you agree not to:

  • Attempt to gain unauthorized access to accounts, systems, data, or features, or to bypass access controls or permissions.
  • Probe, scan, or test vulnerabilities except with prior written permission from the operator.
  • Interfere with or disrupt the Services, including through malware, denial-of-service attacks, or abusive automation.
  • Upload or distribute malware, spam, or content that is unlawful, or that infringes intellectual property, privacy, or other rights of others.
  • Impersonate others or misrepresent your affiliation with a person or organization.
  • Use the Services in violation of applicable law or of third-party platform rules that apply to your use (including Discord’s rules when Discord authentication or APIs are involved).

6. Game masters, moderators, and administrators

Some Services may define elevated roles (for example game masters (“GMs”), moderators, or administrators). Those roles exist only where a Service implements them. Elevated roles may allow viewing or editing other users’ content within the scope described for that Service.

  • Users with elevated roles must use those permissions only for legitimate operation of the Service or community activities the Service is designed to support.
  • Elevated access does not grant ownership of another user’s original User Content.
  • Administrators may have technical access required to operate, secure, or support the Service.

Service-specific pages describe role behaviour for each active Service. Do not assume every HopeLab project uses the same role model.

7. Changes to Services and Terms

We may change features, availability, or these Terms from time to time. When we make material changes to these Terms, we will update the “Last updated” date on this page and may provide additional notice where appropriate or required.

Continued use of a Service after updated Terms become effective constitutes acceptance of the updated Terms, except where applicable law requires a different process. If you do not agree to updated Terms, you must stop using the affected Services.

We do not promise uninterrupted availability, specific uptime, or that any particular feature will remain available indefinitely.

8. Disclaimers

To the fullest extent permitted by applicable law, the Services are provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Nothing in these Terms excludes or limits any warranty, consumer right, or remedy that cannot be excluded or limited under applicable law. If you are a consumer, you may have mandatory rights that prevail over these disclaimers.

9. Limitation of liability

To the fullest extent permitted by applicable law, [Operator Name] and its contributors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or business opportunities, arising out of or related to your use of the Services.

To the fullest extent permitted by applicable law, the total aggregate liability arising out of or related to the Services or these Terms is limited to the greater of (a) the amounts you paid (if any) to the operator for the Service giving rise to the claim during the twelve (12) months before the claim, or (b) fifty euros (EUR 50).

These limitations do not apply to liability that cannot be limited under applicable law, including liability for death or personal injury caused by negligence where such limitation is prohibited, or for fraud or fraudulent misrepresentation.

10. General

If any provision of these Terms is held unenforceable, the remaining provisions remain in effect. These Terms constitute the agreement between you and [Operator Name] regarding the Services, and supersede conflicting prior agreements on the same subject, except for separate written agreements the operator expressly enters into with you.

Our Privacy Policy explains how personal data is handled for HopeLab Legal and points to service-specific pages for active Services.
